China has become much more active in influencing the international human rights system in recent years. This talk introduces China’s contemporary human rights theory and practice in the United Nations, focusing on Beijing’s strategies in the Human Rights Council (HRC). I observe that China, with enough support from other countries, has consistently sought to distort the HRC’s procedures, undermine relevant institutions and promote the government’s preferred norms that are in tension with international human rights principles. I offer a critique of Beijing’s latest version of the unique concept “Human Rights with Chinese Characteristics,” which features a statist, development-above-all view.

More broadly, China’s behavior should be examined in light of the rise of authoritarianism in the international system. The international human rights regime, a product of postwar liberalism, is increasingly falling under the shadow of authoritarian countries that try to shape the regime in favor of their illiberal agendas. China, the most resourceful authoritarian party-state, has formed loose coalitions with authoritarian governments and developing countries that have different state interests but share a common distaste for human rights scrutiny. This talk probes how authoritarian countries affect the international legal order and proposes the importance of studying group dynamics in any international political institution, contributing to the current scholarship about “authoritarian international law.”

What explains failures of large-scale anti-corruption campaigns in reducing corruption? Theories on developing country corruption see corruption as either a problem of weak formal institutions that incentivize naturally opportunistic actors or as remnants of traditional behaviors that persist despite changing modern state boundaries and regulations. Neither helps explain how participants continuously strategize to reframe and articulate the morality of those questionable transactions.

This paper, through multi-year fieldwork and 34 interviews with business elites in China’s Guangdong province, examines how officials and businesses reconfigured their strategies of corruption during a recent anti-corruption campaign. We find that key actors engaged in ‘moral articulation’ – devising moral repertoires and realigning common exchange practices to accepted meaning frames to safeguard interests and obfuscate their activities. In doing so, they challenged some aspects of state-initiated definitions of corruption while embracing others. Rather than eliciting conformity, the campaign prompted new ingenious action frames that helped internally justify corruption and allowed questionable exchange practices to continue on.

This paper is concerned with cross-border ethnic groups in Sino-Southeast Asia – the area where southwestern China and northern continental Southeast Asia meet. More specifically, my research focuses on the case of the Wa in the Wa Hills – an old civilization that predates the making of modern states. Today, the area is carved up and fixed by territorial subunits with varying degrees of autonomy that traverse the Sino-Burmese border: the Wa Self-Administered Division (Special Region 2) in the northeastern Shan State in Myanmar, and Ximeng Wa Autonomous County, Cangyuan Wa Autonomous County, and Wa ethnic townships in northern Lancang Lahu Autonomous County in southwestern Yunnan Province in China. Ethnically, it is a diverse region with numerous Native highland peoples, who share common characteristics such as language, ancestry, and cultural beliefs that provide the foundation for a nation (ethnic), and of whom the Wa constitute the majority group (75 to 80 percent) with a population of approximately one million people. These so-called cross-border ethnic groups often have potential contradictory implications: they may be seen as both a source of threat and support for nation and state-building efforts. As such, they are simultaneously brought together and yet also kept apart.

The paper is divided into four sections – the first is a consideration of material collected on ethnic groups in China and in Myanmar. The second section provides an overview of Chinese and Burmese ethnopolitics, that is, the state’s mode of administering and governing frontier ethnic minority areas, and China’s territorial expansion and border policies since economic reforms in the 1970s and, in particular, in the three decades since the early 1990s. The third section focuses on the case of the Wa people in the Wa Hills, which is illustrative of the situation that exists across the Sino-Burmese border. Finally, the last section examines in more detail the effects of China’s transformation on cross-border ethnic groups and ethnic autonomous territories both locally and beyond the border. I suggest that, in the case of the Wa, the process of ‘opening up’ has involved a shifting of the border and brought about an increasing asymmetry in relations between the two sides.
